S.B. Disanayaka's nomination to be challenged
(Lanka-e-News, December 30, 2008, 9.15 PM) Several groups that will file nominations for the Central Provincial Council election are to challenge the legitimacy of the nomination of United National Party (UNP) Chief Ministerial candidate S.B. Disanayaka.

Nominations will be closed at 12 noon tomorrow (31) and objections are entertained within a period of one hour after the nominations close in.
The groups will challenge the legitimacy of S. B. Disanayaka’s candidacy for the election since his civic rights have been suspended following rigorous imprisonment for contempt of court.

Meanwhile, the legal experts point out that the Provincial Council act has not made provisions to register objections for nominations.

S. B. Disanayaka said that the Retaining Officer could reject a nomination based on only the matters like signatures of the candidates, the statements of those who attested the nominations, the number of candidates, the approval of the party secretary for the political party nominations and the responsibility of the person who filed nomination.
He further stated that the Supreme Court had issued an interim order to reinsert S.B. Disanayaka’s name back in the electoral registry. Further, the exclusion of the name from the electoral registry does not bar a person being a candidate for an election, he says.

Disanayaka says that the victory of the UNP is definite at the Central Provincial Council election.

United People’s Freedom Alliance (UPFA) former Chief Minister Sarath Ekanayaka who contests for the post for another term says that there are no provisions for filing objections under the Provincial Council act. However, UPFA is waiting for the legal ramifications of the Retaining Officer’s decision either to accept or to reject nominations, he says.

Ekanayaka says that his personal position is that Disanayaka should be allowed to contest since he should be rejected not through legal arguments but by people’s power.

Legal experts point out that S.B. Disanayaka is not barred to be a candidate of the Provincial Council election according to the interim order issued by the Supreme Court.

Whether or not S.B Dissanayake contest as the chief minister candidate of UNP, they will remain in the loosing side.UPFA will win this time with a bigger margin.SB will not be a decisive factor in Sri Lankan politics anymore.
