| General’s second petition filed against 2nd military Court also dismissed |

(Lanka-e-News 30.June.2010 10.00PM) The Appeal Court dismissed the petition filed by General Sarath Fonseka yesterday (29) against the second military Court conducting the trial against him. The petition was dismissed without costs.
The Appeal Court which rejected the petition stated that , as the petition is time barred , it cannot be taken up.
Though the petition states as its primary objection that a judge of the military Court maintained close relations with the Defense Secretary Gotabaya Rajapakse , neither the Defense Secretary nor the Defense Ministry have been made respondents , and therefore the petition is unacceptable , the order clarified.

It is reported that the Court had agreed with the AG’s argument that , as the judges of the second military Court and the Judges’ Attorney had been appointed by the President , objections cannot be raised against it in Court.
Army Commander Lieutenant General Jagath Jaysooriya, members of the second military Court , Major General M P Peiris, Major General S W L Daulugala and Major General M Haturusinghe were cited as respondents in the petition.
The case was heard in the Appeal Court before a panel of judges headed by Sathyahettige |
