Signature of a judge who was not present incorporated in the judgment delivered against Fonseka‘s petition!!
(Lanka-e-News, July 09, 2010, 6.25PM) In the unanimous judgment delivered by a panel of three judges on the petition filed by Gen. Sarath Fonseka seeking an order from the Appeal Court against the Second military Court conducting the trial, a signature of a judge who was not present on the date of trial has been incorporated in the certified copy of the judgment. It is widely questioned in the legal circles as to how such a serious occurrence creep into a judicial decision.

This petition was taken for hearing on 29th June before a panel of three judges, Sathya Hettige (Chairman), Rohini Marasinghe and Sarath De Abrew.

Sarath Abrew has not however signed the certified copy of the judgment. In place of his signature, a judge who was not present at the trial, Anil Gunaratne has placed the signature.

When this case was taken for hearing at the initial stages, the judges, Ranjith Silva and Anil Gunaratne who were in the judges panel, withdrew citing personal reasons. At that juncture, Justice Hettige became the chairman of the panel.
It was Justice Hettige who announced the judgment arrived at by the three judges panel, Sathya Hettige. Rohini Marasinghe and Sarath De Abrew. Justice Hettige who delivered the judgment with the other two judges assenting, stated that the preliminary objections raised against the second military Court have been rejected. Because this petition has been filed after the period has lapsed, it is time barred, it was pointed out.

According to reports reaching Lanka e news, the Attorney at Law, Romesh De Silva who appeared for the petitioner Gen. Fonseka has been summoned by Justice Hettige to meet him in his chambers this morning (9).

Who is Sathya Hettige. He was a previous judge in Fiji. Because he couldn't do his jod, Fiji government cancel his visa and sent back to Sri Lanka. During his period in Fiji he could even speak English. Now he is the Chairman of the Appeal court. Can you believe this. My godness Rajapakse has promoted him as Supreme Court Judge. What the hell you are taking about. When they appointed weak and not qualified people they do what ever shit. Is this the Judiciary in sri Lanka? Come on.. Believe me the same thing is happening to the Supreme Court. This Present Cheif Justice and in coming Shirani Bandaranaike former University Professor both are dance the same way... This is wonder in Asia...

Why are there no judges of the calibre of Hema Basnayake, EFN Gratien, HNG Fernando, Neville Samarakoon. Mark Fernando, and so on. I suppose the quality of our Judiciary is also a reflection on our society.

The public has lost the faith on judiciary. It is a well known factor that judiciary is politically biased. Whatever the president wants the judgment is there forthwith. Its really Idiamin's goverence. How long the people of this country look up and wait for the fairness?

Why Sri Lankan general public is so silent, General received more votes than MR in presidential election, yet none of those voters raise there voice. If any other country such thing happened, even in mid east such as Iran. In Africa Zimbabwe, we saw mass riots against govt. yet our people only bother about there day to day life and cricket. Why General’s legal team is failed to back up his claim success fully, where is UNP and JVP maggots?
