Military above the law?
(Lanka-e-News, July 17, 2010, 4.50PM) July 15 my father was supposed to be at Parliament at 9.30am for a Health Ministry advisory Committee meeting.

Despite a clear order by the courts that this Colombo District MP should be allowed without any hindrance to attend Parliamentary meetings, committee meetings, group meetings and other discussions relating to Parliamentary matters - the Military Commander didn't allow him to leave the navy head quarters where he is detained.

This is a direct and contemptuous violation of the court order by the Army Commander.

It is also the second violation of this kind.

My father is under civil law and the military is not allowed to dictate such terms as these to him. They provide him security but his daily routine and his constitutional rights are all under civil regulations and civil legislature.

This just goes to show that now the military, and those commanding the military deem themselves to be higher than the Sri Lankan legal system.
Are we now at a stage where, we are reverting to being subjects, surfs and slaves? Perhaps we should not even call our nation a Democratic Socialist Republic, but simply a Kingdom. For, we have no rights or freedoms anymore.

Will they now unilaterally "hang' my father, as threatened by the Defense Secretary, even though the courts say no?

If this is happening to an elected Member of Parliament - what rights will the general people of Sri Lanka have? What rights for the minorities?
On one hand they pile case upon case on my father. On the other, they stand in blatant violation of all court orders and even go further to harass and intimidate the legislature.

What happens when a trained military equipped with weapons, thinks it does not need to follow the laws of the land?

My father believes in accountability and the fairness of the legal system (when it is free from coercion might I add) - this is why he says time and time again that he will prove his innocence in any court of law. That he can stand up to any allegation. That he will face any accuser.

The military is not anyone's personal attendant - and the legal system is not simply a polite request.

The sooner we Sri Lankans understand this the sooner we can stop this horrible tide from drowning us all.

To all those who has pointed their comments at me – 1) Who ever does wrong is wrong, whether you, me a dictator, royal, general or otherwise. 2) Please read what I have written, I’m not white washing anyone like most of you trying to do. 3) Don’t ruin our motherland with your nasty thoughts and comments if you ever want to see a change. Change needed will not happen with arrogance, blind faith, shouting slogans. All your negativity brings negative effects than doing any good. Work hard to achieve not work dirty. 4) No one has the right to do wrong just because someone else does wrong. Measuring the percentage or the weight of one’s wrong will not correct the wrong that has less weight. 5) Finally, grow up people as you say. Blind faith does not lead you to the paradise of democracy. If you are currently suffering due to a dictator, be glad that we have ginger out here & the chili is imprisoned. Suraj

No one knows what kind of system we are in. Sri Lankan polititions has different ideas, UN is confued over lanka activities, People lost in this day to day changes, God is confused whom to help, This is call Abbudassa Kale, when the doorman goes and put the crown and the real king sits in the prison.

Suraj de silva, The whole world knows who Sarath Fonseka. When people get popular some people who have nothing sling mud at the popular one and try to get some kind of satisfaction.Familiar? 'Dogs bark at the moon'. Suraj! who are you? Does anybody know what you have been doing all your life time? Raping, steeling,wasting time, insulting popular people, hurting children because you cant do any better than their fathers. Grow up. Do something useful than hating a war hero who saved the country!.

Mr. Silva, u r talking about general's greed to power.Nonsense. What about the familiy you are talking about in politics, for generations. Is it for the pure love of the people, that family is in politics or for plundering mother lanka or for greed ? to which category do they fall into.? it seems that you are white washing the Royal family or one who got desciplined by the Gen. He did not utter a lie. But the authorities bribed & bought the Reporter to "fix" him. Any person entering politics in a legitimate manner ended up in the grave. They were masacred by the Govt goons. To name a few, Gen Kobbekaduwa , Gen Janaka Perera, Gen Algama etc., etc. It is the work of all leftist government. Dont think masses live happily enjoying freedom in sri lanka. Even the writer cannot write form overeas. Govt goons track you to threaten. People like me have to use pen names in fear of persecution. As yo say if General had done anything wrong, I admit it is wrong. On the other hand if you truly calculate & compare the misdeeds done by General as you state, and what had been committed by the Dictator, would be like one kilo by General & few Tons by the Dictator. On that scale General is far more Superior to the present Dictator & more suitable & desciplined to be the President of sri lanka. Funny thing is all cases agsainst the General is when he is out from the army. No one saw these while he was in service? Sri lankan legal system works only for opponents ? By the way I have been in the army and never heard about a rape case against him. This too is similar to the white flag story. Dictator can make or brake the law. It is being done in a manner which sri Lanka had never seen. My only advise to any one in uniform is keen on entering politics do not risk your life, but stage a Coup. That is the best way to do. If you are genuine there is no place for that in Sri Lanka. It is all Criminals in power & they not let it slip off from them. By hook or crook, will hang on to power. Now hell with ordinary people. Price lowering is only up to Elections. There after let them go to hell. That is the reason why General decided to enter politics. Silva , open your eyes.

Dear Apsara, I totally agree with your article and extremely sympathetic to your father's current plight. What goes around comes arround.We have a total dictatorship and family rule in Srilanka.There is no law and order in that land. "....my dear Duwa your father and this cruel dictator Rajapaksa and his ruling party,The Rajapaksa brothers,friends and family members ltd,committed so much atrocities against the poor innocent tamil people. I am not referring to LTTE but the innocent people. Did you or your father ever speak against that? Your father was instrumental in destroying the innocent lives of hundreds of thousands of Tamil people! Yes there are guys just trying to prove certain points. If you lick the bum of the Rajas then you can be free people. Others who have the guts to talk against will end up as prisoners. Even they cannot prove anything against. This is Sri Lanka today. Yes As Mr. Suraj comments, people live freely in Sri Lanka? Yes when hunger and hardships climb up that they can't bear anymore then see what will take place. You can't lie to people every day. Sooner the truth will prevail. What you are writing has no basis, and only good for stooges who support this chronic government. See for yourself what is happening around? Can you agree they are good for this country?

Dear Apsara, You have become a writer since your father’s misfortune and have seen several articles written by you. I too sympathise your situation as a child that loves the father very much. Unfortunately the same sympathy is not felt for your father who once was a great General. He himself and few of cronies around him he responsible for his misfortune today. If he knew at least what he is talking, he wouldn’t have gone though the same fate and he would have remained a great hero and a great General who contributed to end terrorism from our beautiful country. Please take a relook at what your father had been doing since he decided to enter politics. He uttered so much trying to bring disgrace to one political family and unfortunately he was blind to understand that what he utters bring disrepute to our motherland of which he wanted to be the President. I am glad that he is not the President today as he would not end up his opponents in the prison but at the cemetery. The average Citizen does not have all the difficulties that your father, his cronies and sometimes you and media try to show to the world. There are millions and millions of people in this country that has freedom that your father & his political cronies think that they fight for. Your father did not enter politics for people of this country. He came for the greed of power and he was showing worse qualities as a politician than the politicians that was there. Most Sri Lankans have understood this and that’s why the country is not at a standstill with riots & people on street fighting until your father is freed up. If your father & rest of his cronies and your family understand this, the sooner you can see him becoming a free man. Pray for him and pray that the hatred within him; the horrible tide will not drown him further and further. Just one more thing, if your father believes in accountability and the fairness he wouldn’t be blamed misdeeds he did while in the army including a rape. Suraj
