| Police commit multiple crimes to cover up Judge ‘Sarath Mahaththaya’s crime |

(Lanka-e-News, July 20, 2010, 11.45PM) After the Lanka e news website exposed the criminal act of seduction that was committed on a 20 year old servant girl working in the house of an Appeal Court judge , it is reported that the Nuwara Eliya police is using force on this victim asking her to accept cash and is trying to suppress this case.
This girl who was allegedly molested by the Appeal Court judge is being summoned by the Police twice or thrice a day and is being compelled to yield to the police pressure. Not enough the harassment the victim suffered at the hands of the Judge , now the police too is persecuting her , it is learnt.
The victim who is a resident of Shanthipura Dustrict , Nuwara eliya has been employed in the house of the judge from the 08-05-2010 for a salary of Rs. 7000/-. Per month. Two months salary was paid to the girl at the women’s affairs office after deducting Rs. 2000/-, that is only 12,000/- instead of Rs. 14,000/- on the ground that , their child has fallen sick after eating the food cooked by the victim.
An individual who appeared with the Judge’s wife claiming that he was a Lawyer had taken the victim’s signature on a letter at the children and women’s affairs office. |

The young girl has made a complaint to the Colombo children and women’s affairs office that ‘Sarath Mahthaya’ molested her. This complaint has been entered under 210/ 236 reference No. on 2010-06-28. The Office had registered the complaint as a minor offence. But , a high ranking police officer said , a complaint as this should be entered under the G C I B and registered in the GCR records.
The women’s affairs office which recorded the complaint has later kept the girl in the custody of the Salvation Army Headquarters near the General Hospital. On the 30th of June she had been produced before the Courts medical officer, Ajith Tenekoon. |

The children and women’s affairs office has been handed over the full medical report following the medical officer’s investigation. After receiving the report this office instead of producing the victim before the Court or taking any other legal action , has sent the victim back to the house where the crime was committed.
Is a case filed in connection with this incident? If so, in which Court? When we asked these questions from the children and women’s affairs office OIC Balachandra , he said , no action has been filed in any Court , and the relevant report has been forwarded to the Attorney General.(AG).
The Colombo Medical officer Tennekoon when answering our inquiries ,said, the report was forwarded by the children and women’s office to him . Later ,after his investigations the medical report was sent to the women’s office. However , he stated that he cannot reveal anything contained in the reports.
The initial inquiries into this crime had been conducted by Vinitha Gamage , an officer of the children and women’s affairs office. The Senior Police Authority Muthubanda of that office who was to continue with the inquiries further , has instead interrupted it mid way.Muthubanda is to go on retirement in the next few weeks.
There are reports that this judge who is the accused in this case of seduction has also the following charges against him :
• Assaulting a contractor named Chitrasena who was constructing the Judge’s house .
• Assaulting a Buddhist Priest of Dhammikarama , Ratmalana and attempting to shoot him .
• Assaulting a Galkissa traffic police officer on the main Highway and attempting to shoot him.
• Outraging the modesty of a girl by holding her hand while in the Court premises.
• seducing two sisters of the same family from Piliyandala .
Although some of these accusations had been reported to the Police, it is reported that using his official position they have been suppressed.
A group of police officers too ,who haven’t disclosed their names have written letters to the President, Prime Minister, Speaker, Chief Justice, all Ministers , opposition leader , Defense secretary, Courts Secretary, and Foreign Diplomats urging to conduct investigations impartially and dispassionately , and take action against the judge who had allegedly committed the criminal act of seduction. |
