(Lanka-e-News -27.May.2017, 11.45PM) The verdict unlawfully delivered earlier by Colombo chief magistrate Gihan Pilapitiya to release the 15 elephants of the wild life department which were held captive without licenses or on spurious licenses by various bigwigs during the ‘nefarious decade’ back to them after signing bonds, was suspended via an interim order issued by Colombo High court.
The Attorney General (AG) challenging the unlawful decision of Gihan Pilapitiya filed a counter petition before High court judge Mahilal Waidyathileke today.(26)
The State counsel Dileepa Peiris who appeared on behalf of the AG via the petition requested that the decision of the magistrate court to release the Elephants be suspended, and an interim restraining order be issued.
Dileepa Peiris’ primary objection was based on the premise “ under no circumstances can the ‘court production’ be handed over back to the accused on a bond now or at a future date, and it can be released only to the aggrieved party” which premise was ignored by the chief magistrate when he delivered his decision.
His second contention was : In the judgment of Gihan Pilapitya no legal grounds have been cited in support. His decision was founded on emotion and not on legal background. His decision was centered on giving protection to Buddhism , and releasing of Elephants to the accused (rogues) , rather than on rules of law, without any legal basis being cited.
The high court judge after taking into consideration the submissions of the State counsel suspended Pilapitiya’s unlawful decision for a period of 14 days via an interim restraining order .
