(Lanka-e-News- 20.April.2015, 4.20PM) If ever a competition is held in Sri Lanka (SL) to decide the next worst chief justice (CJ) and most sordid after ex CJ Mohan Peiris in the history of CJ’s in Sri Lanka(SL) to disgrace the bench , without doubt even a kindergarten class child will conclude it is Sarath N Silva, another ex CJ. This is because , though Mohan Peiris may have managed to escape from being caught with a whore by his night security police constable , Sarath Silva however succeeded in creating this putrid record –caught with a woman behind bushes inside the car.
Sarath Silva a byword for most deplorable and despicable conduct holds the record for being the most depraved of the CJs and a disgrace to the judiciary ,so much so that after saving Mahinda Rajapakse in the Tsunami fund fraud case , he, without an iota of shame openly stated , it is he who rescued Mahinda Rajapakse . Moreover , Sarath Silva who should commit suicide over his egregious guilt based on his ignominious conduct, instead, unashamedly and unconscionably tendered a casual apology in defense , and laughed off his grave criminal official misconduct . Truly speaking that case should be heard again under a different panel of judges, if justice is to be meted out duly.
The worst part of this scenario is , while everyone including the new CJ Kanagasabapathy Sripavan are aware about the sordid and squalid nature of Sarath Nanda Silva , the former is nevertheless worshipping the latter whereby he has demeaned and discredited himself as well as the judiciary wholesale, based on reports.
Sadly, Sripavan has not once but twice degraded himself and left a trail of offensive odor in the judicial sphere owing to notorious Sarath Silva …….
An annual pinkama (almsgiving) was held out of funds of the funds of judges in memory of late Raja Sirimevan (R.S.) Wanasundara , an ex supreme court justice who died in 2012 . It was Sarath Silva who played the key role at this ceremony . The latter after making a contribution of Rs. 10,000.00 , collected monies from other judges , to conduct the annual ‘Wanasundara dhana’ .
However March this year , Sarath Silva selected an organization to give this dhana (almsgiving) , its name is the ‘Sumangala foundation.’ This foundation was basically Udarata , and well known as a crude primitive organization. It is a well and widely known fact that it is the Sumangala foundation which is clamoring vociferously that the national flag should be the Udarata flag of the ancient Kings.
This time the Wanasundra dhana was given under the patronage of Sarath Silva by the Sumangala foundation. Of course , it is no issue to the people when a judge , retired judge or a sex starved scoundrel of a judge , gives a dhana even conjointly with a racist ..But it is certainly a grave and serious issue to everybody who has the realization that the hallowed judicial traditions and Institutions of SL are being compromised by Sarath Silva when he invited Sripavan as the chief guest for this dhana .
The reason for this is : this dhana which was given on behalf of Late Wanasundara was conducted all these years with the participation of judges jointly, has now descended to the lowliest sordid levels as one given by a racist despicable organization , and the present CJ by attending this most reprehensibly degraded all sacrosanct judicial traditions.
Three HC judges of Udarata on hearing that the present CJ is going to attend such an event which is not consistent with judicial traditions had immediately informed SriPavan in writing that his attending such an event of a savage organization like Sumangala foundation which is out and out racial and communal , will be unbecoming for a CJ , and therefore to steer clear of it by not attending the event. Nevertheless , Sripavan owing to Sarath Silva’s obnoxious pressures had attended the almsgiving casting away all respect he is expected to accord to the dignified judiciary and his lofty position , while also subordinating the hollowed judicial values to serve the interests of rejected vicious racist elements.
Hence , in the not too distant future , the outcry ‘destroyed, destroyed’ could be expected , but what is more important than that is , it is the people who are going to be at the receiving end of all these sordid and villainous activities of the judges , and not the judges who commit all the treacheries and trickeries compromising the dignity of the bench .By the time the damage done by these judicial villains are known it will be too late to effect repairs .
While the aforementioned facts focus on a deadly ‘virus’ that is being generated from within the judicial sphere, in another similar episode , Sripavan CJ prior to this, after securing the new appointment ,ceremonially went on a pilgrimage to the Dalada Maligawa. The post of CJ is one that should be independent and he is expected to steer clear of racism and religious extremism to ensure that independence.
If a CJ makes a pilgrimage to Dalada Maligawa , or Munneswaram or Mecca and makes that an official duty after his appointment , what follows in its train is his invariable prostitution of official position and his compromising the judiciary’s religious independence .
No matter what , Sripavan after taking oaths as CJ choosing the Dalada Maligawa pilgrimage, apparently to regenerate his Tamil customs through Buddhism seems to be more due to religious incongruence stemming from his own degenerative nature , which is a result of the contamination of his post spread by none other than the aforementioned ex CJ , the notorious morally depraved cad.
It is noteworthy that Sarath Silva was the first CJ to go on pilgrimage to Dalada Maligawa immediately after his elevation . His successor ,Ms. Shiranee Bandaranaike CJ did not indulge in such sanctimonious humbug or desecrate the sacred soils of Dalada Maligawa. Only later on she paid homage to Dalada Maligawa privately ,underlining the need to uphold the independence of the sacrosanct judiciary without allowing one’s religious fervors to undermine it . Unfortunately , it is Sarath Silva the sanctimonious hypocrite who had roped in Sripavan to act hypocritically as he did . Not enough the insult Sripavan poured on himself by swallowing Sarath Silva’s despicable counsel , Sriapavan committed a most grave indiscretion at the Dalada Maligawa not because he performed the pilgrimage but because he officially met its Basnayake Nilame , Nilanga Dhela Bandara in charge of the Maligawa , despite Sripavan having knowledge of the stark fact that this Nilame is a notorious fraud .
Nilanga Dhela Bandara is already facing a number of cases in the courts of Mahawa , north central , Sabaragamuwa and Uva provinces , based on a number of charges , and the present CJ has therefore voluntarily walked into trouble by meeting him officially . No other CJ has ever poured scorn on himself voluntarily and bared himself to public spurn as this CJ who is misguided and misled into doom by the sanctimonious humbug , Sarath Silva.
It is an incontrovertible fact that a CJ going in search of such a crook, against whom so many criminal cases exist, and to meet him to exchange pleasantries and make ‘embracing’ gestures constitute a prostitution of official position , specially when a CJ indulges in them . Of course Sripavan is not such an immature judge not to know this and its gravity , yet it is now very clear that by abjectly yielding to Sarath Silva’s villainous manipulations , he is carving a short cut to his own disaster.
These two incidents only go to prove that most dangerous portents are in store when judicial decisions are made in the future by the new CJ Kanagasabapathy Sripavan for ,what is the guarantee that his judicial verdicts will not be tainted by the evil and unscrupulous influences of morally depraved ex CJ Sarath Silva , the main villain standing in the way obstructing dispensation of true justice. Surely this danger is directly damaging the independence of SL’s judiciary and denting the sovereignty of the rule of law , undoubtedly.
