(Lanka-e-News- 13.May.2015, 1.00PM) One of the judges of the three judge bench of the Supreme court (SC) to hear the fundamental rights (FR) petition filed by Gotabaya Rajapakse against the police special Financial crimes investigation division (FCID), withdrew from the FR case , and that judge is Buwaneka Aluvihara .
This petition was to be heard by Buvaneka Aluvihara (the president of the panel) , Eva Wanasundara and Sarath De Abrew based on the names furnished by the SC registrar . ( LeN named Sisira Abrew erroneously as the third judge yesterday(12) , whereas the third judge is Sarath Abrew)
Might we point out , Sisira Abrew is a virtuous judge in profound contrast to Sarath Abrew the notorious ,with a putrid antecedence with several charges tainting his professional career. Sarath Abrew was involved in a number of crimes including forcing a domestic worker in his house to yield to his sexual advances; assaulting a police constable of his security detail ; attacking people who he meets and so forth. Despite his eccentricity and criminalities he is still a judge , most infamous though. It is such a disgraceful judge who has been appointed to the panel of this case.
When Aluvihara notified this morning that he was withdrawing from this FR petition case for personal reasons , Romesh De Silva , the lawyer for Gotabaya said , another judge shall be appointed to the panel in his place as this hearing must somehow be heard today.
Yet , the chief justice instructed the petition shall be heard before Eva Wanasundara and Sarath Abrew ..
The respondents named in this petition , the prime minister and others were not noticed to appear in court. Only an order from the attorney general was there .
In the recent past Gotabaya Rajapakse has been dodging the courts on several occasions , and this FR petition too was aimed at averting his arrest. The media reported , of the Rajapakses , Gotabaya is the biggest coward and is most alarmed over arrests. No wonder he is known among the people as ‘Baya Gotha’ .
In any event , Buwaneka Aluvihara who withdrew himself from this case is a notorious pro Rajapakse crony. It is Aluvihara when he was in the attorney general’s (AG) department who appeared on behalf of the Gotabaya Rajapakses in the white flag framed up case against General Fonseka that decided to jail him.
May we highlight Lanka e news being aware of Aluvihara’s putrid antecedence while questioning Aluvihara’s suitability for this case noted, the people will decide based on the verdict he will be delivering today.
