(Lanka-e-News- 04.Nov.2015, 11.55PM) The blossoming of the sapling planted by the victorious rainbow revolution of 8 th January became most fragrant when the Supreme court issued notice on president Maithripala Sirisena . This notice was issued in relation to a government tender based on which a company has filed a petition in the Supreme court (SC) alleging that owing to this tender being granted to the wrong party , the government incurred a loss of Rs. 2000 million !
Since the day the executive presidency was introduced in 1978 , until now, because of the immunity from legal action enjoyed by the executive president , no case could be filed against the president nor he be made a party to a legal action. Following the victory of the rainbow revolution on 8 th January 2015 however , this presidential immunity was withdrawn by the 19th amendment passed by the good governance government under its 100 days program.
When this petition was heard yesterday , the objection was raised that the president cannot be named as a respondent . However the chief justice SriPavan overruling the objection said, a case can be heard against the president as a minister. Previously the legal position was no case can be filed against the president under any circumstance , even a divorce suit.
Nobel Resources Co. had filed this action on the ground that while this Co. had made a lesser tender bid for the supply of coal to the government , the tender was awarded to ‘Swiss Singapore ‘ Co. that offered to supply the commodity at a higher price, whereby the government incurred a loss of Rs. 2000 million !
The chief justice ordered that summons be issued on the president , prime minister and a group of members of the Cabinet to appear in court on 15 th December.
This action of the SC certainly has put a plaster across the cavernous stinking mouths of the pro Rajapakse clan who scream ‘whither good governance?’
