(Lanka-e-News- 25.Nov.2015, 7.30AM) Supreme court judge Sarath Abrew was indicted on two counts of using force and committing rape on 37 years old Nilusha Damayanthi on 26 th June or thereabout while she was working as a domestic aide in his house. Apart from this case filed in the high court , another case was filed against Abrew in the magistrate court for causing minor injuries to the same victim using a pistol.
Abrew had previously too been involved in a number of such rapes committed on his domestic aides .On each occasion he had been able to circumvent the law by using his legal knowledge and his position as a judge. All these crimes were committed by him during the tenure of office of ex president Mahinda Rajapakse a byword for lawlessness ,his bosom pal. Unfortunately for him when he committed the last crime on which he is now indicted , his bosom pal Mahinda had got thrown out of power lock ,stock and barrel.
May we remind , it was Lanka e news always first with the news and best with the views that first exposed the crimes of Abrew undeterred and undaunted by the evil powers then of the Rajapakse regime that gave protection to this rapist .On 28 th June we published a report making this exposure under the caption ‘Abrew who gave bizarre verdict not to arrest Gotabaya faces rape charges …..’ Even after this exposure , the media coolies ensured that Abrew’s name is not made known in keeping with its past putrid habits.
In any event the police conducted the preliminary investigation without yielding to pressures. Nevertheless when Abrew was to be arrested , a group within the Arttorney general’s (AG) department who are close pals of Abrew opposed it. SSP D.R.L. Ranaweera who conducted this investigation fearlessly however was transferred to Amparai.Finally the culprit Abrew escaped the long arms of the law , and continued to mount the SC bench . Being born with animal instincts and shameless , he did not resign his post either. This drove the new government of good governance to a very embarrassing situation.
Though the AG was under pressure from some front line lawyers on baseless grounds that by incarcerating a judge the judicial dignity may be compromised ,in the end AG Yuvanjana Wanasundara Wijethileke created history by filing charges against this scoundrel of a judge , and instituting legal action.
Lanka e news which was in the vanguard of the efforts to enforce the laws against a wrongdoing judge Sarath Abrew is pleased with this dvelopment . When we thanked the AG for his bold action ,the AG in reply humbly said, he has acted according to the laws and followed his conscience throughout his life when discharging his duties , and therefore he does not expect any appreciation in that direction. The AG while expressing that also said , he is hurt by the accusations leveled against him by politicos that he is kowtowing to money. It is the view of the politicians that every government officer is swayed by money and takes decisions under that influence, but in his case , he has never any day taken decisions kowtowing to pressures of any department or influenced by money , and his decisions have always been in conformity with the laws, the AG emphasized.
AG Yuvanjana Wanasundara Wjethileke who created a most exemplary precedent by filing a case against a SC judge for the first time in SL ‘s history is due for retirement on January 1 st 2016.
